To ensure that justice is accessible to all, we offer a “No Win, No Fee” policy to our clients in most Personal Injury and Disputed Estates matters.
1. Eligibility
Our “No Win, No Fee” policy is available to clients who meet the following criteria:
- The case must fall within the areas of law that we specialize in, as determined by our firm (e.g. Personal Injury and Disputed Estates); and
- The client must have a legitimate and strong legal claim.
2. How It Works
Under our “No Win, No Fee” policy, clients are not required to pay any legal fees, including lawyers’ fees and barristers’ fees at the beginning of the case. We will cover these expenses on your behalf.
If we are successful in obtaining a favourable outcome for your case, we will charge your legal fees as a deduction from your final settlement. If, for any reason, we are unable to secure a successful outcome for your case, you will not be responsible for any legal fees incurred during the representation.
3. Costs and Disbursements
It’s important to note that while our firm will cover most legal expenses, some disbursements, such as court filing fees and expert reports, may not be covered under this policy. You will be responsible for these expenses regardless of the case’s outcome.
In some circumstances where clients can demonstrate a genuine inability to afford disbursements, we will be able to apply for litigation funding on your behalf.
4. Your Responsibilities
To ensure a successful partnership under the “No Win, No Fee” policy, we expect our clients to:
- Provide truthful and accurate information regarding their case;
- Be actively involved in the case and cooperate with our firm’s solicitors.
- Notify us promptly of any changes or developments in their case.
5. Case Evaluation
Before agreeing to take on a case under the “No Win, No Fee” policy, we will conduct an initial evaluation to assess the likelihood of success. We reserve the right to decline cases that do not meet our criteria or have a low probability of success.
6. Confidentiality
All information and discussions related to your case will be kept confidential, and solicitor-client privilege will be maintained throughout the process.
